These Accommodation Booking Terms & Conditions and Website Terms & Conditions of Use apply to the property located at 6 Hunts Lane, Avoca Beach, NSW 2251 (the “Property”).

1. Accommodation Bookings and Payment

1.1 Leisure Stay Bookings
A deposit equal to fifty percent (50%) of the total booking value is required to secure your reservation. The balance must be paid no later than fourteen (14) days prior to arrival. Rockpool House may also require a bond. Bookings may be cancelled at our discretion if payment or bond is not received prior to check-in.

1.2 General
All rates are quoted in Australian dollars (AUD) and include GST. Rates are subject to change without notice; however, any confirmed booking will not be affected. Any verbal quote provided is an estimate only.

1.3 Card Processing Fees
A card processing fee applies to all credit and debit card transactions.

2. Accommodation Cancellations

a. Bookings cancelled more than sixty (60) days prior to check-in will receive a full refund.
b. Bookings cancelled up to fourteen (14) days prior to check-in will receive a 50% refund.
c. Bookings cancelled within fourteen (14) days of check-in, or no-shows, are non-refundable.
d. Where payment was made by Visa, Mastercard, or American Express, Rockpool House reserves the right to recover merchant fees associated with cancelled bookings.

3. Check-In and Check-Out

3.1 Check-In
Check-in is available between 3:00pm and 5:00pm on the date of arrival. Arrivals outside these times require prior approval from management.

3.2 Check-Out
Check-out is required by 10:00am on the date of departure, unless otherwise agreed with management. Late departures may incur additional fees.

4. Number of Guests

The number of guests must not exceed the number specified in the booking. Additional guests may only be accommodated with prior written approval from management. Rockpool House reserves the right to remove any persons exceeding the agreed number of guests.

5. Parties and Noise

Parties are strictly prohibited at all times. As the Property is located in a residential area, excessive noise and music are not permitted after 10:00pm. Guests found in breach of this clause may be evicted without refund.

6. Smoking

Smoking is strictly prohibited inside the Property and on any timber decking or balconies.

7. Pets

Pets are strictly prohibited at the Property.

8. Accommodation

8.1 Provided Amenities
For the duration of your stay, Rockpool House will provide bed linens, towels, and basic toiletries.

8.2 Guest Responsibilities
Guests must:
a. not remove any bed linens, towels, or toiletries from the Property;
b. return the accommodation to a reasonable state of cleanliness; and
c. comply with all reasonable directions given by management.

9. Swimming

Guests who choose to use the pool, spa, or cold-plunge facilities do so entirely at their own risk.

10. Damage

10.1 Reporting
Any damage to, or theft of, the Property or its contents must be reported to management immediately. Inspections will be conducted following your stay to assess any such damage or theft.

10.2 Charges
Rockpool House reserves the right to charge guests for repair or replacement costs resulting from damage or theft during their stay.

10.3 Post-Stay Notification
Where damage or theft is identified after check-out, guests will be notified in writing and issued with an invoice. Payment must be made within fourteen (14) days of receipt.

11. Limitation of Liability and Indemnity

11.1 General
To the fullest extent permitted by law, Rockpool House:
a. disclaims all warranties, express or implied, not expressly set out in these Terms and Conditions;
b. makes no representation, warranty, or guarantee regarding the reliability, quality, suitability, or availability of the Property, or that any stay at the Property will be uninterrupted or error-free.

11.2 Liability Exclusions
Rockpool House shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including (without limitation) loss of profits, loss of data, personal injury, or property damage, whether arising in contract, tort, or otherwise, even if advised of the possibility of such damages.

11.3 Guest Acknowledgement
Guests acknowledge that Rockpool House will not be liable for any claim, loss, damage, cost, or expense, whether direct or indirect, arising from:
a. any delay in providing services at the Property; or
b. the inability to accommodate or satisfy any request, whether or not a booking has been made.

11.4 Indemnity
Guests agree to indemnify Rockpool House against all claims, losses, damages, costs, and expenses (including legal fees) arising from their use of the Property or breach of these Terms and Conditions, except to the extent that such claims, losses, damages, costs, or expenses are directly caused or contributed to by the negligent act of Rockpool House or its staff.

12. Termination

12.1 Retention of Payments
Upon receipt of notice of termination from a guest, Rockpool House reserves the right to retain any payments made up to and including the date of such notice.

12.2 Termination Events
Rockpool House may terminate these Terms and Conditions immediately upon the occurrence of any of the following:
a. non-payment of any amount due under clause 1;
b. unlawful conduct or any other breach of these Terms and Conditions.

12.3 Effective Date
Notice of termination will take effect from the date specified in the notice, or, if no date is specified, immediately upon issue of the notice.

12.4 Payments
To the extent permitted by law, payments already made are non-refundable upon a Termination Event.
